Workers’ Comp Credits
Drug-free Workplace (5%)
Florida’s workers’ compensation law allows employers to qualify for a five percent discount on their workers’ compensation and employer’s liability insurance premiums by implementing a drug-free workplace program in accordance with certain requirements. Requirements include written policies and testing, among others. For most employers, this program is voluntary. However, an employer must establish a program if it contracts with the state government or local governments to provide construction, electrical or alarm system work.
In General, to qualify for the premium discounts, an employer must establish a drug-free workplace program that requires:
• Job applicants to submit to testing following an offer of employment
• Employees to submit to reasonable suspicion testing
• Employees to submit to routinely scheduled employee fitness-for-duty testing
• Employees to submit to follow-up testing following their entrance into an employee assistance program or drug rehabilitation program (unless an employee voluntarily enters a program, then follow-up testing is optional).
Random testing is also allowed, though not required, for an employer to qualify for the premium discounts.

Safety Program (2%)
Florida employers are permitted to implement a Safety Program and are eligible to receive up to a 2% premium credit on a qualified program. It must be certified that the workplace safety program includes the following provisions:
- Written safety policy and safety rules
- Safety inspections
- Preventative maintenance
- Safety training
- First aid
- Accident investigation
- Necessary record keeping

Florida Contracting Classification Premium Adjustment Plan (FCCPAP)
The Florida Contractors Credit Premium Adjustment Program (FCCPAP) provides a Workers Compensation credit ranging between 5% and 25% of annual premium. The credit is for construction employers that pay their employees greater than the state average wage, as calculated by the Department of Financial Services.
